Terms of service

Article 1: Applicability
These terms and conditions apply to all offers, agreements, and deliveries of services by OrangeRaptor.com (hereinafter "we", "us", "our") to the customer (hereinafter "you", "the customer", "the customers") who use our website and the services offered by us.

Article 2: Service Provision
We offer server services. Our responsibility extends solely to making available and maintaining the server infrastructure.

Article 3: Exclusion of Liability
We shall never be liable for any damage, of whatever nature, direct or indirect, arising from or related to the use of our services, the inability to use the services, data loss, service interruptions, or actions of other users or third parties. This applies regardless of the cause of the damage, unless there is intent or gross negligence on the part of our direct management. This includes, but is not limited to, damage resulting from (un)planned maintenance, downtime, technical malfunctions, security incidents, or the use of the server by the customer or third parties.

Article 4: Striving for Solutions
Although we exclude our liability as stated in Article 3, we always strive to resolve any issues with our customers in mutual consultation. We will make reasonable efforts to assist you with questions or problems regarding our basic server services.

Article 5: Responsibility for Backups
The customer is at all times solely responsible for creating and maintaining adequate backups of all data stored on the server made available by us. We offer no guarantee that backups of your data are available and are not liable for any data loss, regardless of the cause.

Article 6: Responsibility for Third-Party mods
The customer is fully responsible for the installation, configuration, functioning, and consequences of the use of all third-party software, applications, and modifications (including, but not limited to, 3rd party mods) on the server made available by us. We do not offer support for such additions and are not liable for problems or damage arising therefrom.

Article 7: Prices and Payment
The purchase of a server provides access for 30 days. All costs are pre-paid, and there are no recurring monthly costs.

Article 8: Duration and Termination
Access expires after 30 days and the service is automatically paused. Thereafter, the user can extend the service by making a new purchase.

Article 9: Changes to the Terms
We reserve the right to change these terms and conditions at any time. The amended terms will be published on our website and will take effect 1 day after publication. If you continue to use our services after the amended terms come into effect, you are deemed to have accepted the changes.

Article 10: Applicable Law and Dispute Resolution
These terms and all agreements between us and the customer are exclusively governed by Dutch law. Disputes arising from or related to these terms or the agreement will be submitted to the competent court in the Netherlands, unless mandatory legal provisions dictate otherwise.

Article 12: Compliance with Laws and Regulations

The customer is required to comply with all applicable Dutch laws and regulations. As the Netherlands is part of the European Union, this also includes relevant European legislation. Our services may not be used for any illegal activities, including but not limited to hosting or distributing prohibited content, engaging in cybercrime, or violating copyright laws. If a customer fails to comply, we reserve the right to immediately suspend or terminate the service.
